1. Who We Are
MyAutoBudget ("the Service") is operated by Josh Jones, an independent software developer based in Arizona, United States ("we," "us," or "our"). We are not a registered financial institution, licensed financial advisor, or fiduciary. MyAutoBudget is not a bank and does not provide FDIC or similar deposit insurance. Funds held in your own bank accounts remain subject to your bank's terms and protections. You can reach us at support@myautobudget.com. We currently provide support by email only.
2. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. We will notify you of material changes by email or by a prominent notice within the Service at least 14 days before they take effect. Continuing to use the Service after that notice period constitutes acceptance of the updated Terms.
3. Service Description
MyAutoBudget is a personal budgeting tool that helps you track accounts, income, bills, and spending allocations. The Service may include automated calculations, projections, and reports derived from data you provide. It optionally integrates with Plaid to retrieve account balances, transaction data, and certain account metadata from financial institutions through Plaid.
4. Subscription & Billing
The Service offers a free trial period, after which a paid subscription is required for continued access. Subscription pricing and trial length are displayed at sign-up. You may cancel your subscription at any time through the billing portal. Coupon codes may grant extended or permanent free access at our discretion.
5. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. By creating an account you represent that you meet these requirements.
6. Account Responsibilities
You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to notify us promptly at support@myautobudget.com if you suspect unauthorized access.
7. No Financial Advice
The Service is an informational tool only. Nothing in the Service constitutes, and nothing produced by the Service should be construed as, financial, investment, tax, accounting, legal, or any other form of professional advice. We are not a registered investment adviser, broker-dealer, certified financial planner, certified public accountant, tax preparer, attorney, or fiduciary, and no advisory, fiduciary, or professional-client relationship is created by your use of the Service. All numbers, charts, projections, allocations, recommendations, action plans, tax estimates, vesting calculations, debt-payoff trajectories, asset-growth curves, and similar outputs are illustrative estimates derived solely from data you (or third parties acting on your behalf) entered or imported, subject to model assumptions, simplifications, and rounding, and may be materially incorrect. You alone are responsible for your financial decisions. You should independently verify every figure before relying on it and consult an appropriately licensed professional (such as a CFP®, CPA, EA, or attorney admitted in your jurisdiction) before making any tax, investment, retirement, estate, insurance, or borrowing decision. To the maximum extent permitted by law, we expressly disclaim any duty of care arising from your use of the Service.
8. Accuracy Disclaimer
We do not guarantee that any calculation, projection, estimate, simulation, recommendation, or report produced by the Service is accurate, complete, current, or suitable for any particular purpose. Many outputs — including weekly action plans, long-horizon asset and debt projections, Monte Carlo simulations of investment outcomes, equity-vesting tax estimates, supplemental withholding figures, FICA calculations, state-tax estimates, savings-goal ETAs, and credit-card payoff curves — rely on intentional simplifications of real-world tax law, market behaviour, and personal circumstances. We do not, and cannot, model your full tax situation; we do not capture every jurisdiction, filing status, deduction, credit, alternative minimum tax consequence, wage-base cap, supplemental-wage stacking, or treaty position. Data you enter is processed through automated formulas and heuristics that can produce incorrect or misleading results. The Service may also rely on third-party data sources (such as Plaid bank feeds, Zillow valuations, or market-rate assumptions) that may themselves contain errors, omissions, staleness, or delays. You acknowledge that any reliance you place on the output of the Service is at your own risk and that the Service is not a substitute for professional advice tailored to your circumstances.
9. Limitation of Liability
To the fullest extent permitted by the laws of Arizona, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of your use of — or inability to use — the Service, even if advised of the possibility of such damages.
Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you have actually paid us in the twelve months preceding the claim, or (b) fifty US dollars ($50). This cap applies regardless of the legal theory and even if the above remedies fail of their essential purpose.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
11. Your Data
You retain full ownership of all data you enter into MyAutoBudget. By using the Service you grant us a limited license to store and process your data as necessary to provide, maintain, secure, and improve the Service and its features for you, consistent with our Privacy Policy. We will not sell, rent, or share your data with third parties for marketing purposes. See the Privacy Policy for full details on how we handle your information.
12. Acceptable Use
You agree not to: attempt to gain unauthorized access to other users' data or our infrastructure; use the Service for any unlawful purpose; reverse-engineer, decompile, or disassemble the Service; or transmit malware or disruptive code.
13. Indemnification
You agree to indemnify and hold harmless MyAutoBudget and its operator from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms, except to the extent caused by our own negligence or willful misconduct.
14. Service Availability and Changes
We may modify, suspend, or discontinue features of the Service. For material changes that reduce functionality you currently rely on, we will make reasonable efforts to provide at least 14 days' notice. Routine maintenance, security patches, and minor improvements may be deployed without advance notice.
15. Termination
Either party may terminate this agreement at any time. You may stop using the Service and request deletion of your account. We may suspend or terminate your access if you violate these Terms or if continued provision of the Service to you becomes impractical. If we terminate your account without cause, we will make reasonable efforts to give you at least 14 days' notice and an opportunity to export your data. Sections 7 through 13 and 16 through 20 survive termination.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona. Both parties consent to the personal jurisdiction of those courts.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MyAutoBudget regarding use of the Service and supersede all prior agreements.
19. Translation
These Terms may be available in languages other than English. In the event of any conflict or inconsistency between a translated version and the English version, the English version shall control.

Electronic Signature & Record Consent
By checking the "I agree to the Terms of Use and Privacy Policy" box at signup and clicking the submit button, you agree that your action constitutes a legally-binding electronic signature under the federal Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as enacted in your state. You consent to receive this agreement, any changes to it, and any required legal notices in electronic form. We retain a record of your consent — including the date, the IP address, the user-agent string, and the document version in force at the moment of consent — in an immutable Consent Log. You may withdraw this electronic-records consent at any time by emailing privacy@myautobudget.com, but doing so will terminate your ability to use the Service because all notices and account management are delivered electronically.
Eligibility & Age of Contractual Capacity
You must be of the age of majority in your jurisdiction (eighteen (18) years of age in most US states and Canadian provinces) and legally capable of entering into a binding contract to create an account. The Service requires a valid credit card to complete subscription checkout; you represent that the credit card you use is your own or that you are expressly authorised by the cardholder to use it for this purpose. We may terminate any account we reasonably believe was opened by a minor or by a person without contractual capacity.
Subscription, Billing, and Refunds
The Service is offered on a subscription basis, billed monthly or annually depending on the plan you select. All fees are payable in advance and are processed by our payment processor, Stripe, Inc. Except where required by applicable law, all fees are non-refundable and we do not prorate for partial billing periods. If you cancel, your subscription remains active until the end of the current billing period and will not renew.
We reserve the right to change subscription pricing; any change takes effect only at your next renewal and will be notified to you by email at least thirty (30) days in advance. Continued use of the Service after the effective date constitutes acceptance of the new price.
California residents: you may cancel at any time and, if you cancel within three (3) business days of a new subscription purchase, we will issue a full refund of the most recent billing period. Email privacy@myautobudget.com within that window to request the refund.
Binding Arbitration & Class-Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
(a) Agreement to arbitrate. Except for the carve-outs in paragraph (c) below, any dispute, claim, or controversy arising out of or relating to these Terms or to the Service (a "Dispute") will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the US county where you reside (or, at your election, by videoconference) and will be conducted by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
(b) Class-action waiver. You and MyAutoBudget each agree that any Dispute will be resolved solely on an individual basis. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, representative, consolidated, or private-attorney-general action. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. If this class-action waiver is found to be unenforceable as to a particular claim, that claim (and only that claim) will be severed and resolved in court, while all other claims remain subject to arbitration.
(c) Carve-outs. Either party may (i) bring an individual action in a US small-claims court for any Dispute that qualifies; (ii) seek injunctive relief in a court of competent jurisdiction to prevent the unauthorised use or infringement of intellectual-property rights; and (iii) file a complaint with any governmental agency of competent jurisdiction (including, for California residents, the California Attorney General).
(d) Opt-out. You may opt out of this arbitration agreement by emailing privacy@myautobudget.com with the subject line "Arbitration Opt-Out" within thirty (30) days of your first acceptance of these Terms. Opting out will not affect any other provision of these Terms.
Governing Law & Venue (for non-arbitrable claims)
For any Dispute that is not subject to the arbitration agreement above, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. You and MyAutoBudget consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any such Dispute.
California Civil Code § 1789.3 Notice
In compliance with California Civil Code § 1789.3, users of the Service from California are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
Service Availability & Geographic Restriction
The Service is offered only in the United States, Canada, and Mexico. Attempting to access the Service from a jurisdiction outside that list, or from a jurisdiction subject to US Office of Foreign Assets Control (OFAC) sanctions, will result in an HTTP 451 response and denial of service. You represent that you are not located in, nor a national or resident of, any OFAC-embargoed country, and that you are not on any US government list of restricted parties.
Changes to These Terms
We may revise these Terms at any time. If a revision materially changes your rights or obligations we will notify you by email and / or by a prominent notice within the Service at least thirty (30) days before the revision takes effect. The effective date shown at the top of this document is updated whenever any revision takes effect; the version in force at the moment of your signup is stamped on your Consent Log row and can be requested as part of a data-subject access request. Your continued use of the Service after the effective date of a revision constitutes acceptance of the revised Terms.
