1. Quem Somos
O MyAutoBudget ("o Serviço") é operado por Josh Jones, um programador de software independente sediado no Arizona, Estados Unidos ("nós", "nos" ou "nosso"). Não somos uma instituição financeira registada, um consultor financeiro licenciado ou um fiduciário. O MyAutoBudget não é um banco e não fornece seguro de depósitos FDIC ou similar. Os fundos mantidos nas suas próprias contas bancárias permanecem sujeitos aos termos e proteções do seu banco. Pode contactar-nos em support@myautobudget.com. 2. Aceitação dos Termos
Ao criar uma conta ou usar o Serviço, concorda com estes Termos. Se não concorda, não use o Serviço. Notificaremos sobre alterações materiais por e-mail ou por aviso destacado no Serviço pelo menos 14 dias antes de entrarem em vigor. O uso contínuo do Serviço após esse período de aviso constitui aceitação dos Termos atualizados.
3. Descrição do Serviço
O MyAutoBudget é uma ferramenta de orçamento pessoal que o ajuda a acompanhar contas, rendimentos, faturas e alocações de despesas. O Serviço pode incluir cálculos automatizados, projeções e relatórios derivados dos dados que fornece. Integra-se opcionalmente com o Plaid para obter saldos de contas, dados de transações e determinados metadados de contas de instituições financeiras através do Plaid.
4. Subscrição e faturação
O Serviço oferece um período de teste grátis, após o qual é necessária uma subscrição paga para acesso contínuo. Os preços de subscrição e a duração do teste são apresentados no registo. Pode cancelar a sua subscrição a qualquer momento através do portal de faturação. Códigos de cupão podem conceder acesso gratuito estendido ou permanente ao nosso critério.
5. Elegibilidade
Deve ter pelo menos 18 anos de idade e ser legalmente capaz de celebrar um acordo vinculante. Ao criar uma conta, declara que cumpre estes requisitos.
6. Responsabilidades da Conta
É responsável por manter a confidencialidade das suas credenciais de início de sessão e por toda a atividade na sua conta. Concorda em notificar-nos prontamente em support@myautobudget.com se suspeitar de acesso não autorizado.
7. Sem Conselho Financeiro
O Serviço é apenas uma ferramenta informativa. Nada no Serviço constitui conselho financeiro, de investimento, fiscal, legal ou outro conselho profissional. Todos os cálculos, projeções, alocações e relatórios são estimativas e podem conter imprecisões, diferenças de arredondamento ou erros. Deve verificar independentemente qualquer número antes de tomar decisões financeiras e consultar um profissional qualificado quando apropriado.
8. Aviso De Precisão
Não garantimos que qualquer cálculo, projeção, estimativa ou relatório produzido pelo Serviço seja preciso, completo ou atual. Os dados que introduz podem ser processados através de fórmulas automatizadas e heurísticas que podem produzir resultados incorretos ou enganosos. O Serviço também pode confiar em fontes de dados de terceiros (como feeds bancários Plaid) que podem conter erros, omissões ou atrasos. Reconhece que qualquer confiança que coloca na saída do Serviço é por sua conta e risco.
9. Limitação De Responsabilidade
Na medida máxima permitida pelas leis do Arizona, não seremos responsáveis por indenizações indiretas, incidentais, especiais, consequenciais ou punitivas, ou por qualquer perda de lucros, receita, dados ou boa vontade resultantes do seu uso ou incapacidade de usar o Serviço, mesmo que informado sobre a possibilidade de tais indenizações.
A nossa responsabilidade agregada total por quaisquer reclamações decorrentes destes Termos não excederá o maior de (a) o valor que realmente nos pagou nos doze meses anteriores à reclamação, ou (b) cinquenta dólares americanos ($50). Este limite aplica-se independentemente da teoria legal e mesmo que os recursos acima falhem no seu propósito essencial.
10. Aviso De Garantias
O Serviço é fornecido "tal como está" e "conforme disponível" sem garantias de qualquer tipo, expressas, implícitas ou legais, incluindo, sem limitação, as garantias implícitas de comercialização, adequação a um fim específico e não violação. Não garantimos que o Serviço será ininterrupto, isento de erros ou completamente seguro.
11. Os Seus Dados
Retém a propriedade total de todos os dados que introduz no MyAutoBudget. Ao utilizar o Serviço, concede-nos uma licença limitada para armazenar e processar os seus dados conforme necessário para fornecer, manter, proteger e melhorar o Serviço e as suas funcionalidades para si, de acordo com a nossa Política de Privacidade. 12. Uso Aceitável
Concorda em não: tentar obter acesso não autorizado aos dados de outros utilizadores ou à nossa infraestrutura; usar o Serviço para qualquer propósito ilegal; fazer engenharia inversa, descompilar ou desmontar o Serviço; ou transmitir malware ou código disruptivo.
13. Indenização
Concorda em indenizar e eximir MyAutoBudget e seu operador de reclamações, responsabilidades, indenizações, perdas e despesas (incluindo honorários legais razoáveis) decorrentes do seu uso do Serviço ou sua violação destes Termos, exceto na medida causada pela nossa própria negligência ou conduta intencional ilícita.
14. Disponibilidade E Alterações Do Serviço
Podemos modificar, suspender ou descontinuar funcionalidades do Serviço. Para alterações materiais que reduzem a funcionalidade que depende atualmente, faremos esforços razoáveis para fornecer pelo menos 14 dias de aviso. A manutenção de rotina, patches de segurança e melhorias menores podem ser implementados sem aviso prévio.
15. Rescisão
Qualquer das partes pode resolver este acordo a qualquer momento. Pode deixar de utilizar o Serviço e solicitar a eliminação da sua conta. Podemos suspender ou terminar o seu acesso se violar estes Termos ou se a prestação continuada do Serviço se tornar impraticável. Se terminarmos a sua conta sem justa causa, faremos esforços razoáveis para lhe dar pelo menos 14 dias de aviso prévio e uma oportunidade de exportar os seus dados. As secções 7 a 13 e 16 a 20 sobrevivem à resolução.
16. Lei Aplicável E Disputas
Estes Termos são regidos pelas leis do Estado do Arizona, Estados Unidos, sem consideração aos princípios de conflito de leis. Qualquer disputa decorrente destes Termos será resolvida nos tribunais estaduais ou federais localizados no Condado de Maricopa, Arizona. Ambas as partes consentem com a jurisdição pessoal desses tribunais.
17. Severabilidade
Se qualquer disposição destes Termos for considerada não vinculativa, as disposições restantes continuam em pleno vigor. A disposição não vinculativa será modificada no mínimo necessário para torná-la vinculativa, preservando sua intenção original.
18. Acordo Integral
Estes Termos, juntamente com a Política de Privacidade, constituem o acordo integral entre si e o MyAutoBudget relativamente à utilização do Serviço e substituem todos os acordos anteriores.
19. Tradução
Estes Termos podem estar disponíveis em idiomas diferentes do inglês. Em caso de conflito ou inconsistência entre uma versão traduzida e a versão em inglês, a versão em inglês prevalecerá.

Electronic Signature & Record Consent
By checking the "I agree to the Terms of Use and Privacy Policy" box at signup and clicking the submit button, you agree that your action constitutes a legally-binding electronic signature under the federal Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as enacted in your state. You consent to receive this agreement, any changes to it, and any required legal notices in electronic form. We retain a record of your consent — including the date, the IP address, the user-agent string, and the document version in force at the moment of consent — in an immutable Consent Log. You may withdraw this electronic-records consent at any time by emailing privacy@myautobudget.com, but doing so will terminate your ability to use the Service because all notices and account management are delivered electronically.
Eligibility & Age of Contractual Capacity
You must be of the age of majority in your jurisdiction (eighteen (18) years of age in most US states and Canadian provinces) and legally capable of entering into a binding contract to create an account. The Service requires a valid credit card to complete subscription checkout; you represent that the credit card you use is your own or that you are expressly authorised by the cardholder to use it for this purpose. We may terminate any account we reasonably believe was opened by a minor or by a person without contractual capacity.
Subscription, Billing, and Refunds
The Service is offered on a subscription basis, billed monthly or annually depending on the plan you select. All fees are payable in advance and are processed by our payment processor, Stripe, Inc. Except where required by applicable law, all fees are non-refundable and we do not prorate for partial billing periods. If you cancel, your subscription remains active until the end of the current billing period and will not renew.
We reserve the right to change subscription pricing; any change takes effect only at your next renewal and will be notified to you by email at least thirty (30) days in advance. Continued use of the Service after the effective date constitutes acceptance of the new price.
California residents: you may cancel at any time and, if you cancel within three (3) business days of a new subscription purchase, we will issue a full refund of the most recent billing period. Email privacy@myautobudget.com within that window to request the refund.
Binding Arbitration & Class-Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
(a) Agreement to arbitrate. Except for the carve-outs in paragraph (c) below, any dispute, claim, or controversy arising out of or relating to these Terms or to the Service (a "Dispute") will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the US county where you reside (or, at your election, by videoconference) and will be conducted by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
(b) Class-action waiver. You and MyAutoBudget each agree that any Dispute will be resolved solely on an individual basis. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, representative, consolidated, or private-attorney-general action. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. If this class-action waiver is found to be unenforceable as to a particular claim, that claim (and only that claim) will be severed and resolved in court, while all other claims remain subject to arbitration.
(c) Carve-outs. Either party may (i) bring an individual action in a US small-claims court for any Dispute that qualifies; (ii) seek injunctive relief in a court of competent jurisdiction to prevent the unauthorised use or infringement of intellectual-property rights; and (iii) file a complaint with any governmental agency of competent jurisdiction (including, for California residents, the California Attorney General).
(d) Opt-out. You may opt out of this arbitration agreement by emailing privacy@myautobudget.com with the subject line "Arbitration Opt-Out" within thirty (30) days of your first acceptance of these Terms. Opting out will not affect any other provision of these Terms.
Governing Law & Venue (for non-arbitrable claims)
For any Dispute that is not subject to the arbitration agreement above, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. You and MyAutoBudget consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any such Dispute.
California Civil Code § 1789.3 Notice
In compliance with California Civil Code § 1789.3, users of the Service from California are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
Service Availability & Geographic Restriction
The Service is offered only in the United States, Canada, and Mexico. Attempting to access the Service from a jurisdiction outside that list, or from a jurisdiction subject to US Office of Foreign Assets Control (OFAC) sanctions, will result in an HTTP 451 response and denial of service. You represent that you are not located in, nor a national or resident of, any OFAC-embargoed country, and that you are not on any US government list of restricted parties.
Changes to These Terms
We may revise these Terms at any time. If a revision materially changes your rights or obligations we will notify you by email and / or by a prominent notice within the Service at least thirty (30) days before the revision takes effect. The effective date shown at the top of this document is updated whenever any revision takes effect; the version in force at the moment of your signup is stamped on your Consent Log row and can be requested as part of a data-subject access request. Your continued use of the Service after the effective date of a revision constitutes acceptance of the revised Terms.
