1. Quiénes Somos
MyAutoBudget ("el Servicio") es operado por Josh Jones, un desarrollador de software independiente con sede en Arizona, Estados Unidos ("nosotros", "nos" o "nuestro"). No somos una institución financiera registrada, un asesor financiero con licencia ni un fiduciario. MyAutoBudget no es un banco y no proporciona seguro de depósitos FDIC o similar. Los fondos en sus propias cuentas bancarias permanecen sujetos a los términos y protecciones de su banco. Puede contactarnos en support@myautobudget.com. 2. Aceptación de Términos
Al crear una cuenta o usar el Servicio, acepta estos Términos. Si no está de acuerdo, no use el Servicio. Lo notificaremos de cambios materiales por correo electrónico o mediante un aviso destacado dentro del Servicio al menos 14 días antes de que entren en vigor. Continuar usando el Servicio después de ese período de notificación constituye la aceptación de los Términos actualizados.
3. Descripción del Servicio
MyAutoBudget es una herramienta de presupuesto personal que le ayuda a rastrear cuentas, ingresos, facturas y asignaciones de gastos. El Servicio puede incluir cálculos automatizados, proyecciones e informes derivados de los datos que usted proporciona. Se integra opcionalmente con Plaid para recuperar saldos de cuentas, datos de transacciones y ciertos metadatos de cuentas de instituciones financieras a través de Plaid.
4. Suscripción y facturación
El Servicio ofrece un período de prueba gratuito, tras el cual se requiere una suscripción de pago para seguir accediendo. Los precios de suscripción y la duración de la prueba se muestran al registrarse. Puede cancelar su suscripción en cualquier momento a través del portal de facturación. Los códigos de cupón pueden otorgar acceso gratuito extendido o permanente a nuestra discreción.
5. Elegibilidad
Debe tener al menos 18 años de edad y ser legalmente capaz de celebrar un acuerdo vinculante. Al crear una cuenta, declara que cumple con estos requisitos.
6. Responsabilidades de la Cuenta
Usted es responsable de mantener la confidencialidad de sus credenciales de inicio de sesión y de toda la actividad bajo su cuenta. Acepta notificarnos de inmediato a support@myautobudget.com si sospecha de un acceso no autorizado.
7. Sin Asesoramiento Financiero
El Servicio es solo una herramienta informativa. Nada en el Servicio constituye asesoramiento financiero, de inversión, fiscal, legal u otro profesional. Todos los cálculos, proyecciones, asignaciones e informes son estimaciones y pueden contener inexactitudes, diferencias de redondeo o errores. Debe verificar independientemente cualquier cifra antes de tomar decisiones financieras y consultar a un profesional calificado cuando sea apropiado.
8. Exención de Responsabilidad por Precisión
No garantizamos que ningún cálculo, proyección, estimación o informe producido por el Servicio sea preciso, completo o actual. Los datos que ingrese pueden procesarse a través de fórmulas automatizadas y heurísticas que pueden producir resultados incorrectos o engañosos. El Servicio también puede depender de fuentes de datos de terceros (como feeds de banco de Plaid) que pueden contener errores, omisiones o retrasos. Usted reconoce que cualquier confianza que deposite en el resultado del Servicio es bajo su propio riesgo.
9. Limitación de Responsabilidad
En la medida máxima permitida por las leyes de Arizona, no seremos responsables de daños indirectos, incidentales, especiales, consecuentes o punitivos, ni de ninguna pérdida de ganancias, ingresos, datos o fondo de comercio derivados de su uso de — o incapacidad de usar — el Servicio, incluso si se le ha informado sobre la posibilidad de tales daños.
Nuestra responsabilidad agregada total por cualquier reclamación que surja bajo estos Términos no excederá la mayor de (a) la cantidad que realmente nos ha pagado en los doce meses anteriores al reclamo, o (b) cincuenta dólares estadounidenses ($50). Este límite se aplica independientemente de la teoría legal e incluso si los recursos anteriores no cumplen su propósito esencial.
10. Renuncia de Garantías
El Servicio se proporciona "tal cual" y "según disponibilidad" sin garantías de ningún tipo, ya sean expresas, implícitas o legales, incluidas, entre otras, las garantías implícitas de comerciabilidad, idoneidad para un propósito particular y no infracción. No garantizamos que el Servicio sea ininterrumpido, libre de errores o completamente seguro.
11. Sus Datos
Usted conserva la propiedad total de todos los datos que ingresa en MyAutoBudget. Al usar el Servicio, nos otorga una licencia limitada para almacenar y procesar sus datos según sea necesario para proporcionar, mantener, asegurar y mejorar el Servicio y sus funciones para usted, de acuerdo con nuestra Política de Privacidad. No venderemos, alquilaremos ni compartiremos sus datos con terceros con fines de marketing. Consulte la Política de Privacidad para obtener detalles completos sobre cómo manejamos su información.
12. Uso Aceptable
Usted acepta no: intentar acceso no autorizado a los datos de otros usuarios o a nuestra infraestructura; usar el Servicio para ningún propósito ilegal; hacer ingeniería inversa, descompilar o desensamblar el Servicio; o transmitir malware o código disruptivo.
13. Indemnización
Usted acepta indemnizar y liberar de responsabilidad a MyAutoBudget y su operador de reclamaciones, responsabilidades, daños, pérdidas y gastos (incluidas honorarios legales razonables) que surjan de su uso del Servicio o su violación de estos Términos, excepto en la medida causada por nuestra propia negligencia o mala conducta intencional.
14. Disponibilidad y Cambios del Servicio
Podemos modificar, suspender o descontinuar características del Servicio. Para cambios materiales que reduzcan la funcionalidad en la que actualmente confía, haremos esfuerzos razonables para proporcionar al menos 14 días de aviso. El mantenimiento rutinario, parches de seguridad y mejoras menores pueden implementarse sin aviso previo.
15. Terminación
Cualquiera de las partes puede terminar este acuerdo en cualquier momento. Puede dejar de usar el Servicio y solicitar la eliminación de su cuenta. Podemos suspender o terminar su acceso si viola estos Términos o si la provisión continua del Servicio se vuelve impráctica. Si terminamos su cuenta sin causa, haremos esfuerzos razonables para darle al menos 14 días de aviso previo y la oportunidad de exportar sus datos. Las secciones 7 a 13 y 16 a 20 sobreviven a la terminación.
16. Ley Aplicable y Disputas
Estos Términos se rigen por las leyes del Estado de Arizona, Estados Unidos, sin considerar los principios de conflicto de leyes. Cualquier disputa que surja bajo estos Términos se resolverá en los tribunales estatales o federales ubicados en el Condado de Maricopa, Arizona. Ambas partes consienten la jurisdicción personal de esos tribunales.
17. Separabilidad
Si alguna disposición de estos Términos se considera inaplicable, las disposiciones restantes continúan en plena vigencia. La disposición inaplicable se modificará en la medida mínima necesaria para hacerla aplicable mientras se preserva su intención original.
18. Acuerdo Completo
Estos Términos, junto con la Política de Privacidad, constituyen el acuerdo completo entre usted y MyAutoBudget con respecto al uso del Servicio y reemplazan todos los acuerdos anteriores.
19. Traducción
Estos Términos pueden estar disponibles en idiomas distintos del inglés. En caso de algún conflicto o inconsistencia entre una versión traducida y la versión en inglés, la versión en inglés prevalecerá.

Electronic Signature & Record Consent
By checking the "I agree to the Terms of Use and Privacy Policy" box at signup and clicking the submit button, you agree that your action constitutes a legally-binding electronic signature under the federal Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as enacted in your state. You consent to receive this agreement, any changes to it, and any required legal notices in electronic form. We retain a record of your consent — including the date, the IP address, the user-agent string, and the document version in force at the moment of consent — in an immutable Consent Log. You may withdraw this electronic-records consent at any time by emailing privacy@myautobudget.com, but doing so will terminate your ability to use the Service because all notices and account management are delivered electronically.
Eligibility & Age of Contractual Capacity
You must be of the age of majority in your jurisdiction (eighteen (18) years of age in most US states and Canadian provinces) and legally capable of entering into a binding contract to create an account. The Service requires a valid credit card to complete subscription checkout; you represent that the credit card you use is your own or that you are expressly authorised by the cardholder to use it for this purpose. We may terminate any account we reasonably believe was opened by a minor or by a person without contractual capacity.
Subscription, Billing, and Refunds
The Service is offered on a subscription basis, billed monthly or annually depending on the plan you select. All fees are payable in advance and are processed by our payment processor, Stripe, Inc. Except where required by applicable law, all fees are non-refundable and we do not prorate for partial billing periods. If you cancel, your subscription remains active until the end of the current billing period and will not renew.
We reserve the right to change subscription pricing; any change takes effect only at your next renewal and will be notified to you by email at least thirty (30) days in advance. Continued use of the Service after the effective date constitutes acceptance of the new price.
California residents: you may cancel at any time and, if you cancel within three (3) business days of a new subscription purchase, we will issue a full refund of the most recent billing period. Email privacy@myautobudget.com within that window to request the refund.
Binding Arbitration & Class-Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
(a) Agreement to arbitrate. Except for the carve-outs in paragraph (c) below, any dispute, claim, or controversy arising out of or relating to these Terms or to the Service (a "Dispute") will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the US county where you reside (or, at your election, by videoconference) and will be conducted by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
(b) Class-action waiver. You and MyAutoBudget each agree that any Dispute will be resolved solely on an individual basis. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, representative, consolidated, or private-attorney-general action. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. If this class-action waiver is found to be unenforceable as to a particular claim, that claim (and only that claim) will be severed and resolved in court, while all other claims remain subject to arbitration.
(c) Carve-outs. Either party may (i) bring an individual action in a US small-claims court for any Dispute that qualifies; (ii) seek injunctive relief in a court of competent jurisdiction to prevent the unauthorised use or infringement of intellectual-property rights; and (iii) file a complaint with any governmental agency of competent jurisdiction (including, for California residents, the California Attorney General).
(d) Opt-out. You may opt out of this arbitration agreement by emailing privacy@myautobudget.com with the subject line "Arbitration Opt-Out" within thirty (30) days of your first acceptance of these Terms. Opting out will not affect any other provision of these Terms.
Governing Law & Venue (for non-arbitrable claims)
For any Dispute that is not subject to the arbitration agreement above, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. You and MyAutoBudget consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any such Dispute.
California Civil Code § 1789.3 Notice
In compliance with California Civil Code § 1789.3, users of the Service from California are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
Service Availability & Geographic Restriction
The Service is offered only in the United States, Canada, and Mexico. Attempting to access the Service from a jurisdiction outside that list, or from a jurisdiction subject to US Office of Foreign Assets Control (OFAC) sanctions, will result in an HTTP 451 response and denial of service. You represent that you are not located in, nor a national or resident of, any OFAC-embargoed country, and that you are not on any US government list of restricted parties.
Changes to These Terms
We may revise these Terms at any time. If a revision materially changes your rights or obligations we will notify you by email and / or by a prominent notice within the Service at least thirty (30) days before the revision takes effect. The effective date shown at the top of this document is updated whenever any revision takes effect; the version in force at the moment of your signup is stamped on your Consent Log row and can be requested as part of a data-subject access request. Your continued use of the Service after the effective date of a revision constitutes acceptance of the revised Terms.
