2. قبول الشروط
بإنشاء حساب أو استخدام الخدمة، فإنك توافق على هذه الشروط. إذا كنت غير موافق، لا تستخدم الخدمة. سنخطرك بالتغييرات الجوهرية عبر البريد الإلكتروني أو بإشعار بارز في الخدمة قبل 14 يومًا على الأقل من بدء سريانها. يشكل الاستمرار في استخدام الخدمة بعد فترة الإخطار هذه قبولًا للشروط المحدثة.
3. وصف الخدمة
MyAutoBudget هي أداة ميزانية شخصية تساعدك على تتبع الحسابات والدخل والفواتير ومخصصات الإنفاق. قد تتضمن الخدمة حسابات آلية وتوقعات وتقارير مستمدة من البيانات التي تقدمها. تتكامل اختياريًا مع Plaid لاسترداد أرصدة الحسابات وبيانات المعاملات وبعض البيانات الوصفية للحسابات من المؤسسات المالية من خلال Plaid.
4. الاشتراك والفوترة
تقدم الخدمة فترة تجريبية مجانية، وبعدها يلزم اشتراك مدفوع لمتابعة الاستخدام. يتم عرض أسعار الاشتراك ومدة التجربة عند التسجيل. يمكنك إلغاء اشتراكك في أي وقت من خلال بوابة الفوترة. قد تمنح رموز القسائم وصولاً مجانياً ممتداً أو دائماً حسب تقديرنا.
5. الأهلية
يجب أن تكون بعمر 18 سنة على الأقل وقادراً قانونياً على الدخول في اتفاق ملزم. بإنشاء حساب، تقر بأنك تستوفي هذه المتطلبات.
6. مسؤوليات الحساب
أنت مسؤول عن الحفاظ على سرية بيانات تسجيل الدخول الخاصة بك وعن جميع الأنشطة التي تتم تحت حسابك. أنت توافق على إخطارنا فورًا على support@myautobudget.com إذا كنت تشتبه في وجود وصول غير مصرح به.
7. لا توجد نصائح مالية
الخدمة أداة معلومات فقط. لا شيء في الخدمة يشكل نصائح مالية أو استثمارية أو ضريبية أو قانونية أو مهنية أخرى. جميع الحسابات والتوقعات والتخصيصات والتقارير هي تقديرات وقد تحتوي على عدم دقة أو اختلافات تقريب أو أخطاء. يجب عليك التحقق بشكل مستقل من أي أرقام قبل اتخاذ القرارات المالية واستشارة متخصص مؤهل حيثما كان ذلك مناسباً.
8. إخلاء المسؤولية عن الدقة
نحن لا نضمن أن أي حساب أو توقع أو تقدير أو تقرير ينتج عن الخدمة يكون دقيقًا أو كاملًا أو حاليًا. قد يتم معالجة البيانات التي تدخلها من خلال صيغ مؤتمتة وكشافات يمكن أن ينتج عنها نتائج غير صحيحة أو مضللة. قد تعتمد الخدمة أيضًا على مصادر بيانات تابعة لجهات خارجية (مثل تغذيات Plaid البنكية) التي قد تحتوي بنفسها على أخطاء أو حذف أو تأخير. أنت تقر بأن أي اعتماد تضعه على مخرجات الخدمة يكون على مسؤوليتك الخاصة.
9. تحديد المسؤولية
في أقصى حد يسمح به قانون أريزونا، لن نكون مسؤولين عن أي أضرار غير مباشرة أو عرضية أو خاصة أو حتمية أو عقابية، أو أي خسارة في الأرباح أو الإيرادات أو البيانات أو الحسن النية الناشئة عن استخدامك - أو عدم قدرتك على استخدام - الخدمة، حتى لو تم إخطارك بإمكانية مثل هذه الأضرار.
لن تتجاوز مسؤوليتنا الكلية الإجمالية عن أي مطالبات تنشأ بموجب هذه الشروط الأكثر من (أ) المبلغ الذي دفعته لنا بالفعل في الاثني عشر شهرًا التي سبقت المطالبة، أو (ب) خمسون دولارًا أمريكيًا ($50). ينطبق هذا الحد بغض النظر عن النظرية القانونية وحتى لو فشل الحل أعلاه في تحقيق غرضه الأساسي.
10. إخلاء المسؤولية عن الضمانات
يتم تقديم الخدمة "كما هي" و"كما هي متاحة" دون أي ضمانات من أي نوع، سواء كانت صريحة أو ضمنية أو قانونية، بما في ذلك على سبيل المثال لا الحصر الضمانات الضمنية للتسويق والملاءمة لغرض معين وعدم الانتهاك. نحن لا نضمن أن الخدمة ستكون متواصلة أو خالية من الأخطاء أو آمنة تمامًا.
11. بيانات الخاص بك

12. الاستخدام المقبول
أنت توافق على عدم: محاولة الحصول على وصول غير مصرح به لبيانات المستخدمين الآخرين أو البنية التحتية لدينا؛ استخدام الخدمة لأي غرض غير قانوني؛ هندسة عكسية أو فك تجميع أو تفكيك الخدمة؛ أو إرسال برامج ضارة أو أكواد مزعجة.
13. التعويض
أنت توافق على تعويض وتحمل MyAutoBudget ومشغله من المطالبات والالتزامات والأضرار والخسائر والنفقات (بما في ذلك الرسوم القانونية المعقولة) الناشئة عن استخدامك للخدمة أو انتهاكك لهذه الشروط، باستثناء ما يسبب الإهمال أو السوء القصد من جانبنا.
14. توفر الخدمة والتغييرات
قد نعدل أو نعلق أو نوقف ميزات الخدمة. بالنسبة للتغييرات الجوهرية التي تقلل الوظائف التي تعتمد عليها حاليًا، سنبذل جهودًا معقولة لتوفير إشعار بمدة 14 يومًا على الأقل. قد يتم نشر الصيانة الروتينية والتصحيحات الأمنية والتحسينات الطفيفة بدون إشعار مسبق.
15. الإنهاء
يجوز لأي من الطرفين إنهاء هذه الاتفاقية في أي وقت. يمكنك التوقف عن استخدام الخدمة وطلب حذف حسابك. يجوز لنا تعليق أو إنهاء وصولك إذا انتهكت هذه الشروط أو إذا أصبح الاستمرار في تقديم الخدمة لك غير عملي. إذا أنهينا حسابك دون سبب، سنبذل جهودًا معقولة لمنحك إشعارًا قبل 14 يومًا على الأقل وفرصة لتصدير بياناتك. تظل الأقسام من 7 إلى 13 ومن 16 إلى 20 سارية بعد الإنهاء.
16. القانون الحاكم والنزاعات
تحكم هذه الشروط قوانين ولاية أريزونا بالولايات المتحدة، دون الأخذ في الاعتبار مبادئ تنازع القوانين. سيتم حل أي نزاع ينشأ بموجب هذه الشروط في محاكم الولايات الفدرالية في مقاطعة ماريكوبا بولاية أريزونا. يوافق الطرفان على الاختصاص الشخصي لتلك المحاكم.
17. الانفصال
إذا ثبت أن أي حكم من هذه الشروط غير قابل للتنفيذ، تستمر الأحكام المتبقية في السريان الكامل. سيتم تعديل الحكم غير القابل للتنفيذ بالحد الأدنى الضروري لجعله قابلًا للتنفيذ مع الحفاظ على نيته الأصلية.
18. الاتفاق الكامل
تشكل هذه الشروط، مع سياسة الخصوصية، الاتفاقية الكاملة بينك وبين MyAutoBudget فيما يتعلق باستخدام الخدمة وتحل محل جميع الاتفاقيات السابقة.
19. الترجمة
قد تتوفر هذه الشروط بلغات أخرى غير الإنجليزية. في حالة أي تضارب أو عدم تناسق بين نسخة مترجمة والنسخة الإنجليزية، ستحكم النسخة الإنجليزية.

Electronic Signature & Record Consent
By checking the "I agree to the Terms of Use and Privacy Policy" box at signup and clicking the submit button, you agree that your action constitutes a legally-binding electronic signature under the federal Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as enacted in your state. You consent to receive this agreement, any changes to it, and any required legal notices in electronic form. We retain a record of your consent — including the date, the IP address, the user-agent string, and the document version in force at the moment of consent — in an immutable Consent Log. You may withdraw this electronic-records consent at any time by emailing privacy@myautobudget.com, but doing so will terminate your ability to use the Service because all notices and account management are delivered electronically.
Eligibility & Age of Contractual Capacity
You must be of the age of majority in your jurisdiction (eighteen (18) years of age in most US states and Canadian provinces) and legally capable of entering into a binding contract to create an account. The Service requires a valid credit card to complete subscription checkout; you represent that the credit card you use is your own or that you are expressly authorised by the cardholder to use it for this purpose. We may terminate any account we reasonably believe was opened by a minor or by a person without contractual capacity.
Subscription, Billing, and Refunds
The Service is offered on a subscription basis, billed monthly or annually depending on the plan you select. All fees are payable in advance and are processed by our payment processor, Stripe, Inc. Except where required by applicable law, all fees are non-refundable and we do not prorate for partial billing periods. If you cancel, your subscription remains active until the end of the current billing period and will not renew.
We reserve the right to change subscription pricing; any change takes effect only at your next renewal and will be notified to you by email at least thirty (30) days in advance. Continued use of the Service after the effective date constitutes acceptance of the new price.
California residents: you may cancel at any time and, if you cancel within three (3) business days of a new subscription purchase, we will issue a full refund of the most recent billing period. Email privacy@myautobudget.com within that window to request the refund.
Binding Arbitration & Class-Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
(a) Agreement to arbitrate. Except for the carve-outs in paragraph (c) below, any dispute, claim, or controversy arising out of or relating to these Terms or to the Service (a "Dispute") will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the US county where you reside (or, at your election, by videoconference) and will be conducted by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
(b) Class-action waiver. You and MyAutoBudget each agree that any Dispute will be resolved solely on an individual basis. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, representative, consolidated, or private-attorney-general action. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. If this class-action waiver is found to be unenforceable as to a particular claim, that claim (and only that claim) will be severed and resolved in court, while all other claims remain subject to arbitration.
(c) Carve-outs. Either party may (i) bring an individual action in a US small-claims court for any Dispute that qualifies; (ii) seek injunctive relief in a court of competent jurisdiction to prevent the unauthorised use or infringement of intellectual-property rights; and (iii) file a complaint with any governmental agency of competent jurisdiction (including, for California residents, the California Attorney General).
(d) Opt-out. You may opt out of this arbitration agreement by emailing privacy@myautobudget.com with the subject line "Arbitration Opt-Out" within thirty (30) days of your first acceptance of these Terms. Opting out will not affect any other provision of these Terms.
Governing Law & Venue (for non-arbitrable claims)
For any Dispute that is not subject to the arbitration agreement above, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. You and MyAutoBudget consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any such Dispute.
California Civil Code § 1789.3 Notice
In compliance with California Civil Code § 1789.3, users of the Service from California are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
Service Availability & Geographic Restriction
The Service is offered only in the United States, Canada, and Mexico. Attempting to access the Service from a jurisdiction outside that list, or from a jurisdiction subject to US Office of Foreign Assets Control (OFAC) sanctions, will result in an HTTP 451 response and denial of service. You represent that you are not located in, nor a national or resident of, any OFAC-embargoed country, and that you are not on any US government list of restricted parties.
Changes to These Terms
We may revise these Terms at any time. If a revision materially changes your rights or obligations we will notify you by email and / or by a prominent notice within the Service at least thirty (30) days before the revision takes effect. The effective date shown at the top of this document is updated whenever any revision takes effect; the version in force at the moment of your signup is stamped on your Consent Log row and can be requested as part of a data-subject access request. Your continued use of the Service after the effective date of a revision constitutes acceptance of the revised Terms.
